This privacy statement informs you which data Moco Amsterdam B.V. (Moco Museum) collects from you and for what purpose. The privacy statement is applicable to all services offered by Moco Museum and its subsidiaries, including our websites (the webshop included), mailings and promotions. Any data you provide to Moco Museum will be treated confidentially and in accordance with the General Data Protection Regulation (GDPR).
1. Responsible
Moco Amsterdam B.V. is responsible for the processing of personal data, with its registered domicile at Honthortstraat 20, 1071DE, Amsterdam, and is registered in the company register with number 64274950.
2. Purposes of processing
We process personal data for the performance of our services relating to a visit to our museums in Amsterdam, Barcelona and London. We also process your data when you visit our website (www.mocomuseum.com) for the proper functioning of the website and to tailor the website to your preferences. We also process your personal data when you make purchases through our webshops and ticket shops. In addition, we process personal data in the context of our business operations, including the recruitment and selection of staff, administration, security, IT system management, compliance with legal obligations, archiving, the settlement of payments and the handling of requests, complaints, and disputes. Furthermore, we process personal data for marketing and communication purposes, including managing our websites and sending email newsletters and promotions or sweepstakes. Finally, we process personal data for statistical and analytical purposes, including management information purposes.
3. Processing bases
Legal bases for processing data include entering into agreements with you and executing them, complying with legal obligations and representing our legitimate interests and those of our customers and third parties, such as being able to offer and promote our services. For sending our email newsletter, making personalised offers and using certain cookies and web beacons, we ask for your consent. You may withdraw your consent at any time. If you are under 16 years of age, you must first obtain consent from one of your parents or a legal guardian. In this case, we therefore ask you not to provide us with any data if you have not yet obtained consent.

Moco Members
To receive certain benefits and extras, it is possible to become a Moco Member. If you choose to become a Moco Member, the following personal data may be processed:
- Your name;
- Email address;
- Phone number;
- Data concerning transactions, such as purchases and reservations.
Providing your name, email address and phone number is mandatory when creating your account. We need your name and email address to contact you and set up your account. We only use your phone number to inform you by phone in case of last-minute changes to the service you booked and to ask you to leave a review after your visit.
Purchasing merchandise via the website (without an account)
If you make purchases through the website, the following personal data may be processed:
- Your name;
- Address details;
- Email address;
- Phone number;
- Data concerning transactions (purchases);
- Payment details.
Moco Museum facilities
If you use the Moco Museum facilities, the following personal data may be processed:
- Your name;
- Address details;
- Email address;
- Phone number;
- Data concerning transactions, such as purchases and reservations;
- Data regarding your visit to our facilities;
- Payment details;
- CCTV footage in connection with security.
Marketing and communication
We aim to make our communications as interesting as possible for you. Therefore, our communication is personalised as much as possible and the content - as far as possible and desirable - depends on your preferences.
Newsletter
If you subscribe to our newsletter, the following personal data may be processed:
- Your name;
- Contact details such as email address and/or mobile phone number;
- Your interests if you share them with us.
Personalised emails
We like to share news, suggestions and promotions with our customers by email. If you have a Moco Museum account and have placed at least one order, or if you have given your consent, we may send you emails with suggestions, information about our items and services based on your purchases. You can unsubscribe at any time.
Promotion or win
When you participate in a promotion or win campaign, Moco Museum processes the following data only to register and/or confirm your participation:
- Your name;
- Contact details such as email address and/or mobile phone number;
- If you are the winner, your home address and/or email address will be processed to send the awarded prizes and/or benefits to you. This personal data will be used by us in this case only for this purpose and will only be accessible to those within Moco Museum who deal with these promotions.
- If the promotion or prize draw applies to individuals whose data such as home address and/or email address are already known to us through data collection by other means, as explained in this privacy statement’s other sections, your data will be used to select a winner. Only the winner’s data will be used to send awarded prizes and/or benefits.
The above is only different if you have given permission for your data to be used for another purpose as well.
Statistical and analytical purposes
We analyse information in response to your click, search and purchase behaviour on our website and in our emails (newsletters). This helps us gain insight into our customers and their use of our website and services. These analyses may also be done with the help of third parties. - Other data necessary for handling the enquiry or complaint. All such data are accessible only to those within Moco Museum who are involved in handling your enquiry or complaint.
Recruitment and selection of Moco Museum staff
If you apply, we will process the following to be able to process your application and make you an offer:

- Information included in your CV;
- Passport photograph, if included;
- Your cover letter, if included;
- Other personal data you provide to Moco Museum;
- Other data required by laws and regulations.
4. Recipients of personal data
In principle, we do not share your personal data with third parties.
Moco Museum may engage third parties for the execution of its services and other purposes as mentioned above under section 2. Examples include the sender of orders placed through the webshops, the provider of payment services or a party that supports us in marketing or performs general data analyses for us. Insofar as these parties are to be considered processors under GDPR, Moco Museum will enter into a processor agreement with these parties. In relation to other parties, Moco Museum will also ensure that your data is processed carefully and in accordance with GDPR. Moco Museum will neither sell nor rent your personal data to anyone.
Moco Museum also shares data with third parties if it is obliged to do so under a legal obligation or court order.
5. Transfer of personal data outside the European Economic Area
In principle, Moco Museum does not transfer your personal data outside the European Economic Area (EEA). However, if a transfer is necessary, Moco Museum will ensure that - insofar as the transfer does not take place to a country with an adequate level of protection as referred to in Article 45 of GDPR - appropriate safeguards are put in place in accordance with Article 46 of GDPR or the conditions of Article 49 of GDPR are met.

9. Your rights
You have the right to request Moco Museum to inspect your data. If the data is incorrect, incomplete or irrelevant, you have the right to request its amendment or completion. You also have the right to object to processing and to request Moco Museum to delete the data. In addition, you have the right to data portability. This means that you can request Moco Museum to receive the data we hold on you, so that you can easily transfer that data to another service provider. Under certain conditions, you also have the right to restrict processing so that less data or (temporarily) none of your data is processed.
