1. GENERAL
All visitors to Moco Museum are subject to these terms and conditions. Derogations are valid only if agreed in writing.
2. DEFINITIONS
Moco: Modern Contemporary Museum, business name of Moco Amsterdam B.V., which is the company responsible for the management and operation of the museum.Museum space: Museum space: the Villa Alsberg building at Honthorststraat 20 in Amsterdam, the Netherlands, the building located at Carrer de Montcada 25, Barcelona, Spain and the building located at and 1 Marble Arch, London, UK, including all areas such as the museum shop and the outdoor space within the fenced area.
Visitor: anyone entering the museum space to visit an exhibition and/or attend an event. Consumer: anyone using the Moco website and other online applications, the online ticket shop, the museum store or the online shop.Museum staff: anyone representing the museum and who is identifiable as such.
3. ADMISSION TICKETS
Article 3.1 Moco publishes admission prices through its proprietary channels, on the website, by the entrance to the museum and through direct communications. The prices listed here are not subject to change. Moco cannot be held responsible for (incorrect) publication of admission prices by third parties.
Article 3.2 Admission tickets can be purchased at the entrance, on the website or from one of the museum’s official resellers.
Article 3.3 A visitor will be eligible for a discounted admission fee if he or she meets the applicable conditions. Museum staff may ask for proof of ID for the discounted admission fee. If the visitor cannot produce a proof of ID or the proof of ID is not valid, the visitor will be charged the regular admission price.
Article 3.4 A visitor who has purchased an admission ticket will not be entitled to a refund or any kind of compensation in case of loss or theft of the ticket. Once an admission ticket has been purchased, it cannot be exchanged.
4. OPENING HOURS
Article 4.1 Moco publishes its opening hours through its proprietary channels, on the website, by the entrance to the museum and through direct communications. Moco reserves the right to change previously published opening hours without visitors being entitled to a refund of the price paid for their admission ticket. Moco cannot be held responsible for (incorrect) publication of opening hours by third parties.
Article 4.2 Part of the museum space may be closed to visitors on certain occasions. Such will not entitle visitors to a refund of the admission price. When a substantial part of the museum space is closed to visitors, there will be a notice on the website and by the entrance, and a reduced admission fee will apply or another kind of compensation will be offered.
5. VISITS
Article 5.1 Visitors must conduct themselves in the museum space in compliance with the standards of public order and with these regulations, while always abiding by the instructions of museum staff. Failing that, visitors may be denied access without being entitled to a refund of the admission fee or other costs incurred.
Article 5.2 Parents or supervisors of under-age children, either in organized groups or not, are responsible for the children’s behaviour.
Article 5.3 Visitors are not allowed to bring umbrellas into the museum. There are umbrella stands available by the entrance. Moco does not accept responsibility for damage to or loss or theft of goods left by visitors.
Article 5.4 The museum space can be accessed with small rucksacks or handbags, provided these are hand-carried or worn on the front. Large backpacks, handbags or other bags can be left at the small cloakroom for a fee. What qualifies as large and small is at the discretion of museum staff. Moco does not accept responsibility for damage to or loss or theft of goods left by visitors.
Article 5.5 Museum staff may ask to inspect a visitor’s bag for security reasons.
Article 5.6 Smoking, eating or drinking is not permitted in the museum space, except for in the outside area.
Article 5.7 Pets are not admitted, except for official guide dogs.
Article 5.8 Visitors are liable for any damage caused by them.
Article 5.9 Visitors are allowed to take pictures or shoot video, albeit without the use of additional lighting and tripods.
6. COMPLAINTS
If a visitor has a complaint, he or she can turn to the entrance desk for a complaint form. The completed complaint form can subsequently be handed in to the entrance desk. Complaints can also be submitted by e-mail to:

Moco Museum will respond to complaints within 15 working days.
7. LIABILITY AND FORCE MAJEURE
Article 7.1 Visitors enter the museum space at their own risk. Moco can only be held liable for injury to a visitor or loss or damage to the properties of a visitor if caused by intent or gross negligence on the part of Moco. Damage or injury will be covered up to the amount for which Moco is insured or should in all reasonableness be insured. Possible compensation can never exceed the loss determined by Moco’s insurer. Moco can never be held liable for indirect losses or damage.
Article 7.2 Shortcomings caused by force majeure can never be attributed to Moco and will never lead to entitlement to a refund or compensation. Force majeure is a suspensive or resolutive condition for these general terms and conditions.
8. PRIVACY
Article 8.1 There is CCTV video surveillance all over the museum space. Video footage will be stored in line with legal provisions and, whenever required, be shared with the police.
Article 8.2 Moco reserves the right to take photos and shoot video in the museum space to use for publicity purposes. Visitors who object to appearing in such photos and video can let Moco know, and Moco will then endeavour to prevent publication of any photos and video featuring the visitor in question.
Article 8.3 Moco uses cookies to facilitate the use of our website and to compile a profile of consumers’ online behaviour. For this, Moco uses a service provided by Google,which may share the information with third parties if legally required to do so or to the extent that third parties process the information on Google’s behalf. Data collected will not be linked to names, addresses, email addresses, etc. The consumer has the right to request access to the data and have it rectified or erased.
Article 8.4 Consumers can sign up to our online newsletter. Registration data for the newsletter are stored in a database that is used only by Moco and not disclosed to third parties. Consumers can access, rectify or erase their personal data themselves through the newsletter. They can also do so by emailing a request to that effect to:

Article 8.5 Consumers can purchase products from the online shop. The personal data needed for that are requested during the ordering process and stored in a database. These personal data are used only by Moco for the purposes of the purchase. Article 8.6 Consumers can purchase admission tickets on the tickets page on the website. The personal data needed for that are requested during the ordering process and stored in a database operated by our partner Global Partners. These personal data are used only by Moco for the purposes of the purchase. The consumer has the right to access the personal data, have the personal data rectified or have the personal data erased by submitting a request to that effect to:

9. MUSEUM STORE
Article 9.1 Consumers can purchase products at the museum store or from the online shop. Products displayed are sold at the indicated price, which includes VAT.
Article 9.2 Items purchased at the museum store can be exchanged by returning the product to Moco in person with the receipt within 14 days. Returns are accepted only on account of production or sales faults. The consumer will then receive a non-faulty version of the same product. If the product in question is no longer available, the purchase price will be refunded. Products can also be returned by post, whereby shipping will be at the consumer’s expense.
Article 9.3 The cooling-off period for items purchased online is 14 days. If the product does not meet the consumer’s expectations and is returned within 14 days, the purchase price will be refunded, as will any shipping charges for the initial shipping. Shipping charges for returning the items will not be refunded.
10. APPLICABLE LAW
Dutch law applies to these general terms and conditions and the work if the situation arises in the Netherlands.Spanish law applies to the general terms and conditions and activities when the situation arises in Spain.

Terms & Conditions Moco Applications
By downloading or using the app, these terms will automatically apply to you – you should make sure therefore that you read them carefully before using the app. You’re not allowed to copy, or modify the app, any part of the app, or our trademarks in any way. You’re not allowed to attempt to extract the source code of the app, and you also shouldn’t try to translate the app into other languages, or make derivative versions. The app itself, and all the trade marks, copyright, database rights and other intellectual property rights related to it, still belong to Moco Museum.
Moco Museum is committed to ensuring that the app is as useful and efficient as possible. For that reason, we reserve the right to make changes to the app or to charge for its services, at any time and for any reason. We will never charge you for the app or its services without making it very clear to you exactly what you’re paying for.
The Moco Outside app stores and processes personal data that you have provided to us, in order to provide our Service. It’s your responsibility to keep your phone and access to the app secure. We therefore recommend that you do not jailbreak or root your phone, which is the process of removing software restrictions and limitations imposed by the official operating system of your device. It could make your phone vulnerable to malware/viruses/malicious programs, compromise your phone’s security features and it could mean that the Moco Outside app won’t work properly or at all.
The app does use third party services that declare their own Terms and Conditions.

Unity
You should be aware that there are certain things that Moco Museum will not take responsibility for. Certain functions of the app will require the app to have an active internet connection. The connection can be Wi-Fi, or provided by your mobile network provider, but Moco Museum cannot take responsibility for the app not working at full functionality if you don’t have access to Wi-Fi, and you don’t have any of your data allowance left.
If you’re using the app outside of an area with Wi-Fi, you should remember that your terms of the agreement with your mobile network provider will still apply. As a result, you may be charged by your mobile provider for the cost of data for the duration of the connection while accessing the app, or other third party charges. In using the app, you’re accepting responsibility for any such charges, including roaming data charges if you use the app outside of your home territory (i.e. region or country) without turning off data roaming. If you are not the bill payer for the device on which you’re using the app, please be aware that we assume that you have received permission from the bill payer for using the app.
Along the same lines, Moco Museum cannot always take responsibility for the way you use the app i.e. You need to make sure that your device stays charged – if it runs out of battery and you can’t turn it on to avail the Service, Moco Museum cannot accept responsibility.
With respect to Moco Museum’s responsibility for your use of the app, when you’re using the app, it’s important to bear in mind that although we endeavour to ensure that it is updated and correct at all times, we do rely on third parties to provide information to us so that we can make it available to you. Moco Museum accepts no liability for any loss, direct or indirect, you experience as a result of relying wholly on this functionality of the app.
At some point, we may wish to update the app. The app is currently available on Android – the requirements for system(and for any additional systems we decide to extend the availability of the app to) may change, and you’ll need to download the updates if you want to keep using the app. Moco Museum does not promise that it will always update the app so that it is relevant to you and/or works with the Android version that you have installed on your device. However, you promise to always accept updates to the application when offered to you, We may also wish to stop providing the app, and may terminate use of it at any time without giving notice of termination to you. Unless we tell you otherwise, upon any termination, (a) the rights and licenses granted to you in these terms will end; (b) you must stop using the app, and (if needed) delete it from your device.
Changes to This Terms and Conditions
We may update our Terms and Conditions from time to time. Thus, you are advised to review this page periodically for any changes. We will notify you of any changes by posting the new Terms and Conditions on this page. These terms and conditions are effective as of 2022-05-02
